The Woburn controversy: what we know

Article Abstract:

John Travolta's motion picture 'A Civil Action' inaccurately depicts the story surrounding the case against Beatrice Foods Inc and W.R. Grace Corp. The two companies were charged with polluting two wells in Woburn, MA, with trichloroethylene and tetrachloroethylene which were believed to have caused 11 children to die of leukemia. However, scientific studies indicate that it is doubtful whether the dumped chemicals could cause leukemia. Moreover, even before the companies started operating, citizens have complained about the public water supply.

Beware of the "public nuisance" lawsuit

Article Abstract:

The public nuisance lawsuit is becoming a popular tool by local governments to prevent crime. It has received a great deal of publicity for its novel legal theory. However, it has received much flak from the public because their nature seems to be perverse and personal. Its real purpose is not clearly defined. This anticrime tool is deemed to fail in the long term because it does not require active citizen participation, a factor needed for the success of any crime prevention program.
