The Yusuf and Kadi judgments: The scope of the EC competence in respect of restrictive measures

Article Abstract:

The judgment in the case of Ahmed Ali Yusuf and Al Barkaat International Foundation v. Council of the European Union and Commission of the European Communities brought attention to the fact that the system of sanction under Article 41 of the United Nations' Charter is established to act against states, and that there is no effective system for individuals or entities to directly defend themselves. This case can also be regarded as a pre-warning of the probable concurrence of jurisdictions in the international sphere between the European Courts and the national constitutional courts.

Patient mobility and national health systems

Article Abstract:

The important judgments with regards to patient mobility and national health systems are more common, but now the Watts case which concerned the U.K. National health system (NHS) has seen the case law being applied to the national health system as well.
