The art of communicating arbitral judgments: write ya' heart out!

Article Abstract:

Arbitrators should realize that communicating their judgments in writing is just as important as making the judgment. Arbitrators can improve their writing by addressing the needs of their three audiences: the advocates, the clients and the external review agencies. Arbitrators need not use the traditional organizational format for writing the judgment, but the language should be clear, concise and natural.

Alternatives for labor arbitrators interested in branching out due to a low caseload include the design of alternative-dispute resolution systems, mediation in statutory cases, grievance mediation, fact-finding, traditional grievance and interest arbitration, arbitration of statutory and non-statutory claims and commercial disputes.
