The environment as an ideological weapon: a proposal to criminalize environmental terrorism

Article Abstract:

The author calls for a new criminal law which would punish ecological terrorists for the intentional or reckless destruction of the physical environment. The inapplicability of existing legal doctrines to the crime of ecocide is analyzed.

Attorneys' fees in environmental citizen suits: Should prevailing defendants recover?

Article Abstract:

The author argues that private citizen enforcement of environmental suits would be virtually meaningless without the award of attorney's fees. Topics include judicial discretion in the awarding of fees and standards for awarding fees.

John C. Calhoun becomes the tenth Justice: state sovereignty, judicial review, and environmental law after June 23, 1999

Article Abstract:

The author discusses the Supreme Court's rulings in the 1990s on state sovereignty and judicial review, beginning with Seminole Tribe v. Florida. Subsequent rulings limiting Congress's Article 1 powers are discussed.
