The intersection of federal health information privacy and state administrative law: the protection of individual health data and workers' compensation

Article Abstract:

Proposals to safeguard the confidentiality of medical information obtained by health providers from health payers should include information related to workers' compensation. The Health & Human Services Department recommended such safeguards to Congress but omitted workers' compensation information. Though total privacy is impossible, the sensitive nature of the medical information obtained from workers' compensation applicants mandates that it be included in legislation to protect privacy. The federalism issues thus raised must also be resolved.

The author discusses the rapid expansion of Freedom of Information Act litigation over the years and its impact upon federal agencies. The conflict of FOIA roles within the Justice Department is addressed, along with the pros and cons of discretionary releases.
