The proliferation of disputes, dispute settlement procedures and respect for the rule of law

Article Abstract:

The proliferation of international disputes and international resolution mechanisms requires closer attention from the international community to the ethical standards which is necessary to ensure that the rule of law is observed in the settlement of international disputes. There is also a need for the development and adoption of strict ethical standards applicable to judges and counsel in international tribunals.

Antitrust on Internet time: Microsoft and the law and economics of exclusion

Article Abstract:

The authors discuss the various cases filed against Microsoft Corp. by the US Dept of Justice, claiming Microsoft has committed an antitrust violation by attempting to eliminate Netscape from the web browser market, but conclude Microsoft's restrictive contracts have plausible efficiency justifications and therefore do not violate antitrust law.

Understanding the tobacco settlement: the state as partisan plaintiff

Article Abstract:

The US government was able to bring a suit against four major tobacco firms which they settled at the cost of $246 billion. The tobacco firms settled because they would not be able to afford the cost of litigation with the state and they were also aware of the possible damage to their businesses.
