The reform juggernaut slows down; tort reform backers fight defensive actions now

Article Abstract:

Tort reform movements in the US are slowing down despite the overall favorable attitude of the Bush administration. A law was passed in the District of Columbia that guarantees medical clinics treating the indigent are secured from certain kinds of malpractice claims. Wisconsin passed a bill limiting certain kinds of medical malpractice suit. Fewer bills are being introduced and fewer are passed.

Making a compliance program work

Article Abstract:

Corporate compliance programs should be pro-active, be under the direction of one high-level officer, and include training for employees. The compliance code must forbid behavior the corporation has been found guilty of in the past and also take relevant federal and state laws and regulations into account.

Costly lack of DNA test; jury finds defense attorney negligent for not ordering analysis in sexual assault case

Article Abstract:

A Wisconsin ruling finding a criminal defense lawyer negligent for failing to order DNA testing in a rape trial ending in his client's conviction is discussed. This ruling may decrease defense counsel cooperation in efforts to obtain post-conviction relief for their clients.
