Tobacco suits create heat; cigarette makers have been under fire for decades, but now any company that does or did business with the tobacco industry can be drawn into the fray - along with its insurers

Article Abstract:

Lawsuits against tobacco makers and companies that support them raise a number of important insurance issues for current and potential defendants. These include trade organizations, public relations firms, law firms, and others. The size and number of the claims make insurance vital to pay for defense and cover any claims awarded. Defendants should notify their insurer as soon as possible, and determine what policies apply. Insurers will likely resist, but asbestos cases suggest courses of action for defendants.

... But insurance policies could provide protection; companies may seek refuge in traditional policies and in newly introduced year-2000 coverage

Article Abstract:

Companies evaluating liability insurance when considering the year-2000 problem should be aware that there is even year-2000 coverage. Traditional products such as directors'and officers' and business interruption insurance may not suffice, so these new products should be considered. Holders of this new product must have a corrective plan and submit progress reports. Claims disputes are handled through arbitration rather than the courts.
