The importance of a company's trade secrets protection program is discussed. This should start with an inventory of the secrets and the promulgation of rules for employees on their non-disclosure obligations. Systems to record when and by whom critical information has been accessed and post-employment confidentiality agreements are also important.

Article Abstract:

The Computer Fraud and Abuse Act (CFAA), enacted in 1984 as a criminal law designed to protect credit information on financial institution computers, is discussed. The law has since amended to cover all computers used in interstate commerce, and provided for private civil actions for those injured by the crimes it prohibits.
