Triggering coverage under an "awareness clause" of a claims-made liability policy

Article Abstract:

Claims-made liability policies differ from other liability policies in that the reporting of a claim triggers its coverage, even if the claim occurred before the policy's inception. Most such policies include awareness clauses, requiring potential claims be reported. What constitutes a claim, definition of awareness clauses, notice specificity, insufficient notice, constructive notice cases, and related claims are discussed.

Life insurance conditional binding receipts

Article Abstract:

Courts should respect the express terms of conditional binding receipts which are usually issued by life insurance companies to insurance applicants upon payment of initial premiums. Coverage attaches as of the date of the application for applicants' whose medical histories meet insurance companies' standards. Such receipts benefit insureds and insurance companies because they provide a window of security for both.

The changing role of liability insurance: contract of indemnity or source of compensation?

Article Abstract:

The author explains how liability insurance has evolved from a means of protecting a person or business from a liability judgement into a source of compensation for injured victims. Topics include the injured victim as a third party beneficiary and the insurer's right of indemnification from the insured.
