Vienna Convention on Consular Relations - consular access to detained nationals - International Court of Justice - provisional measures - original jurisdiction of the U.S. Supreme Court

Article Abstract:

This article discusses the International Court of Justice's decision in Germany v. United States regarding the execution of two German nationals. Germany claimed their nationals had not been informed of their right to communicate with consular officials in violation of the Vienna Convention on Consular Relations. The US Supreme Court refused to exercise original jurisdiction and the executions were not stayed.

"Constitutionalization" and dispute settlement in the WTO: national security as an issue of competence

Article Abstract:

Issues involving the US's invocation of the GATT agreement's 'national security' exception to bar review of US law by the World Trade Organization's Dispute Settlement Body are discussed. Issues include the interpretation of the national security exception in the context of the GATT agreement generally, application of the exception to the Helms-Burton Act, and the need for judicial restraint by the WTO.
