Watching paint dry

Article Abstract:

The Clean Air Act Amendments of 1990's Section 183(e) specifies that the EPA regulate emissions of volatile organic compounds (VOCs) from the use, consumption, storage, disposal, destruction or decomposition of consumer and commercial products. Section 183(e) targets paint as a primary source of evaporative VOCs. However, EPA's paint regulations are likely to adversely affect small businesses, since they will have a more difficult time shouldering regulatory costs.

The failure of flow control

Article Abstract:

Flow control refers to the practice of local governments to require all waste within its jurisdiction to be processed in designated facilities. Congress is currently deliberating on several proposals that would allow states to restrict the export of wastes out of local communities through flow control. However, these proposals are contrary to the 200-year-old constitutional principle that bestows the right to regulate or inhibit trade among the states to Congress.

Is EPCRA unconstitutional?

Article Abstract:

The Supreme Court ruling on the Printz vs. United States case may ultimately result in parts of the Emergency Planning and Community Right-to-Know Act (EPCRA) to fall. EPCRA remains questionable as some of their provisions are indistinguishable from the Brady Act that the court overruled. Questions on the constitutional basis of EPCRA may result in a ruling that would scrap portions of the law.
