Ways to avoid being a franchise

Article Abstract:

Prospective franchisors can avoid the substantial costs of complying with federal and state franchising rules if they structure their business so it does not fit the legal definition of a franchise. The Federal Trade Commission's Rule on Franchising lists three criteria: use of a trademark, payment of a fee and significant assistance or control. Some specific guidelines for avoiding this rule and those of the states are presented.

Ontario passes franchise legislation

Article Abstract:

Ontario first franchise-specific legislation, which took effect on July 1, 2000, is discussed. Also covered is the new Alberta Franchises Act, which addresses disclosure by franchisors.
