Acts seek uniform e-policies; E-sign pre-empts state laws if inconsistent with UETA; UETA provisions supersede E-sign

Article Abstract:

The Electronic Signatures in Global and National Commerce Act of 2000 (E-sign) is discussed, which states that all federal and state laws requiring a written document also accept the same document in electronic format. A state's adoption of the Uniform Electronic Transactions Act or a similar statutory scheme will halt E-sign's pre-emption of state law.
