Wilson and all that

Article Abstract:

The European Community Business Transfers Directive and the United Kingdom Transfer of Undertakings Regulations 1981 discuss business rights and obligations towards their employees when business transfers take place. An employee dismissal must be connected to a transfer for the unfair dismissal protection of Regulation 8(1) to kick in. Court of Appeals rulings such as Wilson v. St. Helens Borough Council and Meade and Baxendale v. British Fuels Ltd. also discuss these topics.
