Wishing on Winstar; S&L case may light the way for utility, housing suits

Article Abstract:

United States v. Winstar was a breach of contract case against the federal government for breaking promises to encourage takeovers of failing savings and loans. Much of the opinion concerned the unmistakability doctrine, which holds that any government surrender of sovereign authority must be in unmistakable words. The plurality opinion held that the doctrine does not apply to government agreements to insure a business against the risk of future changes in law law or regulations.

A penchant for privacy; court discourages advocates angling for openness

Article Abstract:

The US Supreme Court cloaks its decision-making process in secrecy, and the justices have also refused to allow cameras in their courtroom or to give personal interviews. The justices might face increased political pressures if court processes were more open and their interactions might also be limited. The justices consider the text of their opinions binding, and more information would not necessarily shed more light on what the ruling means as a matter of law.

The long arm of legal ethics; lawyers in cyberspace can't shake earthbound practice regulations

Article Abstract:

The article describes the application of legal ethics to lawyers advertising and offering their services on the Internet. The article goes into some of the Internet practice issues addressed by state ethics authorities, including links to and from lawyer Web sites and whether Web domain names can differ from firm names.
