Year's top wins for the defense; the most notable defense verdicts of '97 averted multimillion-dollar losses

Article Abstract:

A survey of 1997's most notable and largest defense verdicts is given. Many of the year's most notable civil trial victories came on the defense side. Unlike plaintiffs' victories, defense victories cannot be rated by size, so the list is subjective. The wins are for no liability and no damages, and the amount of damages requested is not necessarily connected to the risk of the case for the defense. Some plaintiffs request massive damages in cases worth little or nothings. The National Law Journal list includes only jury verdicts with a substantial amount at risk and with a reasonable chance for the plaintiff of winning. The list is divided by subject.

The year's most notable defense victories in civil jury trials included several wins for insurance companies and none for employment discrimination defendants. Experts say 75% of the latter that go to trial end in favor of the plaintiffs, and that passage of the Civil Rights Act of 1991 has made it harder for defendants. The list of the year's 15 most important defense victories looks only at civil jury cases with a significant financial stake and meritorious plaintiff claims that nonetheless ended in a complete victory for the defense.

The year 1992's largest verdicts are divided into 14 causes of action and these are listed alphabetically. Under each one or more cases are listed with docket citations, plaintiffs' and defense attorneys, and jury award. A brief description of each case is given. Related articles include one on large Texas verdicts, one on large verdicts by judges and arbitrators, ones on large settlements before and after the trial and after the verdict, and one on large jury awards which did not emerge from appeals and motions intact.
