Private nonprofit group receiving public funds is subject to records act

Article Abstract:

The Ohio Supreme Court ruled in Ohio ex rel. Strothers v. Wertheim that records held by the Citizens of Cuyahoga County Ombudsman Office must be released to a private individual requesting them. The records concerned an Ombudsman Office investigation into charges of child abuse at a juvenile detention center. The Ombudsman Office claimed it was not required to release records because it was not a state-funded, public office. The Supreme Court said exemptions to the Public Records Act, which apply to law enforcement and medical treatment centers, did not apply to the Ombudsman Office.

Private health contractor for jail subject to records law

Article Abstract:

An Arkansas circuit court found in Little Rock Newspapers v. Johnson that the policy and procedure manual of a private company contracting to provide jailhouse medical services was not exempt from the state Freedom of Information Act. A man died in the Pulaski County Jail because he was not provided insulin, and a local newspaper requested documents from the Correctional Medical System to investigate the procedures followed. The court found that the procedures were not confidential and found no intellectual property protection applicable.

University must release student disciplinary records

Article Abstract:

The Ohio Supreme Court held that student disciplinary records were not protected under the Family Educational Rights and Privacy Act and so must be released under the Ohio Open Records Act after names and ID numbers were excluded. The Miami University student newspaper requested access to student disciplinary records while researching student crime trends on campus. The University first released the records removing the date, time, age, gender and location information as well as personal information.
