Patent disputes: Patents re-examined

Article Abstract:

The criticism of the patent system in the U.S. became intensified with the start of the century, which saw the emergence of many proposals for overhauling the system. Debate continues even within legal circles regarding injunctions in infringement cases, and while a group of justices appeared to favor injunctions as the norm in infringement cases, others criticized routine use of injunctions, and commented that patents are being used primarily for obtaining licensing fees rather than producing and selling goods

Patent disputes: 'Trolls' vacuum up patents, demand fees

Article Abstract:

Moneymaking on a patent through licensing is an old practice, and even big businesses make money by licensing patents they do not use themselves. IBM, the largest patent owner in the U.S. earns more than $1.5 billion in licensing fees each year, but some patent trolls vacuum up big portfolios of patents and then wait until defendants have invested heavily in their products before demanding licensing fees.
