Plea Talks In Enron Case Said to Unravel

Article Abstract:

Former Enron CFO Andrew S. Fastow's fraud case and the trial of his wife Lea for false tax returns may proceed without successful completion of plea bargain agreements with federal district court Judge David Hittner. Before Mrs. Fastow could enter a guilty plea to get a reduced sentence, Judge Hittner rejected the terms of the plea agreement between prosecutors and defendant because he did not want the court to be limited by how much time Mrs. Fastow would serve under the plea bargain arrangement. Under the law, the plea deal was not completed because the judge rejected the terms before the plea was entered. Mrs. Fastow, concerned about the judge's future actions, withdrew her involvement in the plea negotiations. The setback for the prosecution involved her husband's possible refusal to provide incriminating information about Enron's chief accounting officer Richard Causey.
