The name of the game is bypass

Article Abstract:

The California Public Utilities Commission's (PUC) decision to deregulate the electricity market has paved the way for other power companies to exploit a loophole in the PUC's stranded cost collection system. The loophole allows customers of utilities over which the PUC has no authority to avoid paying the competition transition charge (CTC). An example is the arrangement between the Modesto Irrigation District, power broker Destec and Praxair, an industrial customer. To prevent this, the PUC has asked the industry to help draw up interim CTC amount.

Who's got jurisdiction?

Article Abstract:

The Federal Energy Regulatory Commission's (FERC) claim of jurisdiction over the rates and terms of electric service transmission is controversial. Pending final ruling from the Supreme Court, the FERC stand has been analyzed by contending parties in terms of its effect on retail and wholesale activities. The possible results of a court decision, which may allow FERC jurisdiction, federal jurisdiction or federal preemption, are discussed.

FERC's transmission pricing policy

Article Abstract:

The Federal Energy Regulatory Commission (FERC) issued its policy statement on transmission pricing in Oct. 1994. In general, the policy allows greater flexibility in determining transmission rates. The policy statement was also based on inputs from as many as 165 parties which took part in discussions. Ddisagreements were rife during discussions, but most agreed on the need for transmission pricing flexibility.
