Anti-dumping in Taiwan: a reflection on the first ten years

Article Abstract:

Taiwan, though not a member of GATT, adopted an anti-dumping law similar to the Tokyo Round Anti-Dumping Code in 1984. The Taiwanese law was not actively enforced until the 1990s, with five cases resulting in anti-dumping duties in 1994. In 1994, Taiwan created an International Trade Ministry that, along with the Ministry of Finance, provides a two-track system for resolving dumping disputes similar to that used in the US. The Taiwanese approach to anti-dumping measures and its mechanisms for deciding them are discussed in detail.

The impact of a hyperinflationary economy on the determination of dumping

Article Abstract:

The US Dept of Commerce's Import Administration, the body in charge of determining whether US antidumping laws have been violated, has developed methods for assessing the cost of goods produced when the exporting nation possesses a hyperinflationary economy. Dumping determinations are made by comparing prices in the US with prices for the good domestically and with the costs faced by the producer of the export. Deviations from standard accounting principles are necessary to compare prices in the US and home markets.

May exchange rate volatility cause dumping injury?

Article Abstract:

The increasing divergence from fixed exchange rates, as agreed to under GATT, towards the use of floating exchange rates has created a potential for more accusations of dumping. Export price comparisons which do not consider exchange rates are an unreasonable means for determining whether or not dumping has occurred. The issues are being treated as interrelated by EC and US agencies in most cases, and should be viewed thusly by all nations.
