EC antidumping policy in a globalizing world: a Dutch perspective

Article Abstract:

A study was conducted to analyze the use of antidumping measures within the European Union and in the World Trade Organization based on a Dutch perspective. Different ways of limiting the use of antidumping instruments were also examined. Results indicated that restrained use of antidumping measures could be realized through the creation of filters that would determine the imposition of such measures. Findings also showed that governments come under domestic pressure to utilize antidumping instrument without regard to its trade policies.

EC anti-subsidy law and practice after the Uruguay Round. A wolf in sheep's clothing?

Article Abstract:

The Uruguay Round Agreement on Subsidies and Countervailing Measures (ASCM) has had a significant impact on the EC's use of its anti-dumping rules. While only 12 countervailing duty investigations were conducted between 1977 and 1995, Fourteen such investigations were conducted from 1996 onwards. These ASCM investigations covered products imported from Brazil, Spain, Argentina, Thailand, Turkey, Norway, India, Peru, Taiwan, India, Korea and Saudi Arabia.

The EC Trade Barriers Regulation: an obstacle to trade?

Article Abstract:

The main role of the Trade Barriers Regulation 3286/94 (TBR) is to give European Community countries a means to fight against obstacles encountered by Community companies in third countries or inside the Community. The effectiveness of the TBR is boosted by its flexibility, as it offers a range of potential responses in the case of an alleged barrier to trade.
