Making sense of sexual harassment law

Article Abstract:

Claims of sexual harassment in the US can be brought under Title VII of the Civil Rights Act of 1964. Current doctrine defines two forms of sexual harassment, quid-pro-quo harassment, and hostile environment harassment (HEH). Unsettled legal issues concern the sort of reasonableness test which can be used to set out the legal criteria for HEH and sexual favoritism. A gendered reasonableness standard is justified by the disadvantages women experience at work. Arguments justifying a ban on sexual favoritism can be based on both a gender-neutral account and the idea that it promotes women's inequality in the workplace. Catharine MacKinnon's views are discussed.

Race and democracy: the controversy over racial vote dilution

Article Abstract:

The most widely hailed piece of legislation to emerge as a result of the nation's civil rights movement is indisputably the Civil Rights Act of 1964 but the Voting Rights Act of 1965 (VRA) is likely the most effective piece of civil rights legislation in US history. The VRA was a decisive step toward realizing the constitutional promise of equal citizenship for Black Americans but this law might not have been so significant if the Supreme Court had not seen fit to broadly interpret the provisions of the act in Allen versus State Board of Elections.

Deliberative democracy: a sympathetic comment

Article Abstract:

Two recent anthologies both titled 'Deliberative Democracy' are discussed, one edited by James Bohman and William Rehg, the other by Jon Elster. Topics include the ideal of a deliberative democracy, arguments for deliberative democracy, the idea of public reason, and other issues.
