Transition from GATT to WTO: a most pragmatic operation

Article Abstract:

An effective transition agreement was negotiated by states parties that were forsaking the General Agreement on Tariffs and Trade 1947 for the World Trade Organization (WTO) Agreement established during the Uruguay Round. The rights and obligations needed to be determined for states remaining subject only to the 1947 agreement, states shifting from the 1947 agreement to the WTO Agreement, states that were to be parties to both agreements and states entering the WTO agreement that were never part of the 1947 agreement. These rights were negotiated in 1994 as part of the WTO Agreement ratification process.

Rules on ethics for the new world trade organization dispute settlement mechanism

Article Abstract:

The Rules of Conduct compose the most detailed and sophisticated requirements enacting responsibilities of impartiality and independence on persons involved in an international dispute settlement process. It is necessary to ensure its feasibility, considering that the dispute settlement rules of the WTO are an extremely powerful system for settling trade disputes. WTO members can again ensure that rules negotiated realizes the interests and demands of all those concerned.

Conflicts of Norms and Conflicts of Jurisdictions: The Relationship between the WTO Agreement and MEAs and other Treaties

Article Abstract:

The difficult and systemic issue of the legal relationship between the World Trade Organization and other treaties is addressed. To appreciate the relationship, one must distinguish between the normative and jurisdictional dimensions of the issue.
