Article Abstract:

The trend of courts not to uphold light and air easements without agreement or statutory protections is discussed. Despite that lack of recognition and because of substantial reductions in value when light or air interference occurs, landowners should consider potential uses of adjoining properties, negotiate easements for protection of air rights, and consider property interests such as negative easements that cannot be destroyed by surface owner interference.
