Capital markets update: 1997 - the year of the FASIT?

Article Abstract:

The financial asset securitization investment trusts (FASIT) provisions of the Internal Revenue Code under the Small Business Job Protection Act of 1996 will be implemented on September 1, 1997. The FASIT will expediate the securitization of debt obligations such as credit card receivables, automobile loans, and home equity loans. Guidelines on FASIT status, permitted assets, ownership and regular interests, taxation of prohibited transactions are presented, but several issues such as artificial valuation rules and ambivalent provisions exist that must be addressed before the FASIT can become a practical tool for securitization transactions.

Western Europe: are the opportunities worth the risks?

US investors are encouraged to consider investing in the Western European property market. This is because of forecasts of declining inflation and interest rates, stable unemployment rates and rising GDP growth rates. With prudent investment rigor, careful tax and legal structuring and efficient currency management, returns to be earned in this market may well be worth the investment.

REITs: will the new legislation solve old problems

The new real estate investment trusts (REITs) legislation should help them achieve greater profits but the complexity of the rules will likely raise restructuring issues and may not trigger interest in REIT shares.
