Confronting the criminals

Article Abstract:

There is some difficulty in determining which party is responsible for removing illegal occupiers. The police will not want to take any action unless criminal damage has taken place. The local authority is unconcerned over private property. In Crawley, England, the police and council are working together to speed up the eviction process. Empty sites are always vulnerable but sometimes the squatters move into occupied premises. It took one firm three weeks to get squatters removed during which time the firm lost business. They also had to pay to clear the site of rubbish.

Killing off litigation

Article Abstract:

The introduction of the UK Civil Procedure Rules 1999 may reduce the number of litigation cases if the consultation draft is accepted. It is likely fewer cases of litigation will be heard in the UK courts if the new pre-action protocol for professional negligence is approved. The new rules have defined how both parties, in a litigation case, should proceed and can punish those who do not act reasonably. It is hoped the draft protocol will allow both parties to discuss their cases more fully and reach a settlement before going to court.
