Casualty provisions that preserve a tenant's lease value

Article Abstract:

Long-term leases that favor tenants can be considered by them to be valuable assets. Leases often do not protect those assets, in the event of fires or other major casualties. Tenants can protect their "assets" by seeking lease terms that obligate landlords to restore premises, should any casualty occur. Landlords may not agree to such terms, however. Tenants can also seek terms that require landlords to buy out leases, should major casualties occur.

Borrowing from a securitization or conduit lender is expected to provide greater benefits once the market turmoil in early 1999 subsides. A well-informed borrower will be able to take advantage of the pricing efficiency and other benefits of these types of loans while handling the complexity of the loan documents and loan requirements.
