Damages to remainder a component of valuation of condemned property

Article Abstract:

The municipalities and government authorities declare some limited properties or strips of land as property for eminent domain purposes. Whether the loss to the remaining property can be added to the cost of condemned property is discussed from the perspective of partial eminent domain takings and takings of non-contiguous property.

Letter of credit reduce landlord's allowed claim rather than gross damages

Article Abstract:

The legal implications of tenant's bankruptcy on landlord's rights where the tenant furnishes letter of credit are discussed. Such LOC's reduce landlord's allowed claim. Relevant cases and legal provisions are also discussed.
