Encroachment of tree roots

Article Abstract:

A land owner can be liable for a tort of nuisance if the roots of any tree planted on his land cause damage to adjoining property. In the recent case of Paterson v Humberside County Council, it was ruled that trees had caused considerable damage to a house and that the local authority concerned could have reduced this risk by regularly pruning the trees.

Whoever finds an object in the United Kingdom on someone else's land is legally allowed to keep it, providing the owner or lawful possessor has not indicated otherwise. If the object is found in the land, however, the legal situation is less well-defined. The owner or lawful possessor of the land has the superior title in this instance.
