HUD targets title insurance commissions for RESPA scrutiny

Article Abstract:

The Dept of Housing and Urban Development and the Texas Department of Insurance have issued policies to protect consumers from kickbacks and unnecessary referral fees involving title insurance companies and agents for services performed. The guidelines issued are in accordance with RESPA's Section 8 rules on unearned referral fees, which bars individuals from giving or receiving fees or kickbacks for the referral of settlement service business and forbids individuals from acquiring or providing any percentage of any fee for settlement services not actually administered.

Title insurance issues for mortgage lenders

Article Abstract:

Issues concerning the protection offered by title insurance are discussed. The limitation of loan policy coverage is encouraging lenders to obtain an owner's policy after acquiring title through foreclosure.
