Hunts Refuse Disposals Ltd v Norfolk Environmental Waste Services Ltd

Article Abstract:

A United Kingdom Court of Appeal hearing of May 22 1996 dismissed an appeal made by Hunts Refuse Disposal Ltd relating to a previous judicial decision in a case concerning refuse disposal rights. The original case considered a 1974 deed in which the appellants were granted the right to deposit rubbish in an excavated area of land for a timespan of 21 years and decided it was a licence agreement rather than a tenancy and that rent was payable for the space taken up by capping and covering materials. The Appeal Court's examination of the deed upheld these decisions.
