Liability for refusing to deliver an assignment of mortgage?

Article Abstract:

A New York state court denied the loan servicerEs motion for summary judgment to dismiss claims brought by the unhappy borrower and its affiliate. Hence both loan servicers and mortgagees are cautioned when deciding whether to provide mortgage assignments and what to charge for them. The servicers and mortgages must ascertain that, when insisting upon a fee or refusing to provide an assignment, they are not causing economic pain that effectively deprives the borrowers from enjoying their contractual right to prepayment.

W.R. GraceEs in-house counsel recently indicted for conspiring to conceal alleged environmental violations

Article Abstract:

The grand jury has indicted W.R. Grace and its chief counsel O. Mario Favorito for concealing information about the health affects due to the mining operations carried out in Libby and Montana. They were charged with three counts of violating the Clean Air Act, one count of conspiracy, two counts of wire fraud and four counts of obstruction of justice.

Internet Privacy for Consumer Financial Information

Article Abstract:

The Gramm-Leach-Bliley Act, Title V, mandates that financial institutions give consumers notice of their privacy collection and disclosure practices. Moreover, the law prohibits them from disclosing to a nonaffiliated third party a consumer's nonpublic personal information unless the consumer consents.
