Nashville's Phil Bredesen: bringing in Dell tops outgoing mayor's legacy

Article Abstract:

Former Nashville, TN, Mayor Phil Bredesen has left a legacy to the city, the memory of which is still fresh among the citizenry and in the local media. This is the successful relocation of Dell Computer Corp and its 3,000-employee complex to an 800-acre site east of Nashville International Airport. Getting Dell to move to Nashville capped Bredesen's aggressive corporate recruitment efforts throughout his two terms in office but brought him intense criticism because of the financial incentives given to the computer retailer.

Handy deposit: although courts have a discretion to order repayment of deposits, these are generally lost if the buyer defaults on the transaction

Article Abstract:

Section 49(2) of the UK's Law of Property Act 1925 seems to give the courts an unlimited discretion based on fairness to order the return of a deposit if a purchaser cannot complete on a deal. It has been shown that contractual exclusion of section 49(2) is not effective. Sellers should not request a deposit of more than 10%, as they would have to show a court special reasons justifying a large deposit. If they could not, the entire deposit would have to be returned to the purchaser.
