Not just simply the best

Article Abstract:

A number of cases have provided valuable information about the enforceability of contractual obligations to use best, or reasonable, endeavours. In Lambert v V Cymru (Wales) Ltd, it was ruled that a clause obliging the defendant 'to use all reasonable endeavours' was enforceable. It is clear that the party alleging failure to take all reasonable steps must prove that the issue was raised in negotiations. In contrast, the party under an obligation to use reasonable endeavours must indicate that a genuine attempt was made to secure the relevant benefits.

KFR contemplates Naval instruction at Greenwich

Article Abstract:

The UK Defence Ministry has awarded Knight Frank and Rutley (KFR) instruction for marketing the buildings of the Royal Naval College, in Greenwich, London, England. The local government and English Heritage will consider all uses for the college which comprises four main buildings, other blocks and gate lodges. Interested parties should notify KFR by Nov 15 1995. KFR won this instruction following competitive tender, and has a good record in dealing with sensitive properties.

Building partnerships

Article Abstract:

The UK construction industry and its clients should move towards a more collaborative approach to procurement in order to substantially reduce construction costs, according to a National Audit Office report entitled 'Modernising Construction.' The government is placing strong emphasis on partnering, in which clients and contractors set up long-term collaborative links for the benefit of both sides.
