Outgoing concerns

Article Abstract:

Tenants who no longer wish to lease a property may chose to assign the lease but the practice has led to some difficulties for the assignees over surety covenants. The covenants regime imposed by the UK Landlord and Tenant (Covenants) Act 1995 has implications for the assignment of leases. The provision of an authorised guarantee agreement has meant in some cases a tenant who is leaving a property has to provide a surety for the incoming tenant or assignee. If the outgoing tenant experiences financial problems the new tenant may lose the lease or have to find an alternative surety.

Article Abstract:

The introduction of the UK Contracts (Rights of Third parties) Bill is likely to have implications for property and construction firms. Third parties will be able to enforce a contract rather than rely on the support of one of the contracting parties. New contracts may state third parties will not have rights. Principal contracts will not be able to be changed to exclude or change the rights of a third party without their permission. The bill will also give subtenants additional rights to compel their superior landlords to fulfill lease covenants.
