Reluctance among courts to enforce oversecured creditors' rights to default interest in bankruptcy proceedings

Article Abstract:

Bankruptcy courts' decisions emphasize judicial reluctance to permit oversecured creditors to accrue default interest once a debtor files for bankruptcy protection. It is suggested that lenders focus on non-default contract interest rate provisions of their loan documentation or the applicable workout documentation.
