Spark of hope for subcontractors

Article Abstract:

The 1996 Housing Grants, Construction and Regeneration Act, Part II, does not give subcontractors any protection against the bankruptcy of the main contractor or their employer. It does allow for the right of adjudication on issues, such as set-off disputes, which often arise in the construction industry. Some industry experts fear that the adjudication process will become too complex. The Act contains a payment system which specifies when payments should be made or withheld. The Act was devised to ease conflict between main and sub contractors. It will be introduced during Apr 1998.

What do we want from the new bill?

Article Abstract:

The British Construction Bill is unlikely to address the real economic problems currently being experienced in the construction industry, but will merely address the working arrangements of any contracts which are set up. The Housing Grants Construction and Regeneration Bill has also been amended with new guidelines to incorporate these changes. Government representatives hope that the industry will experience fewer problems connected to the terms of the contract because legislation will make them simpler and less confrontational.

The Latham Report and its effects

Article Abstract:

A review of the the UK construction industry's organisational practices has culminated in the Latham Report, edited by Sir Michael Latham. The report recommends that many practices in the industry need to change in order to reduce costs and improve productivity. Particular problems are associated with procurement and contractual practices. Specialists in the construction industry are in the best position to facilitate the 30% saving in construction costs that the report recommends.
