Striking a blow for common sense

Article Abstract:

The UK government has recently published plans for the introduction of commonhold, which is intended to overcome the difficulties currently associated with freehold property ownership. The commonhold regime is likely to be optional, both for new and existing developments. A developer would be able to choose from the beginning whether to use commonhold or the conventional leasehold approach. A freeholder would be able to apply to have an existing leasehold development converted to commonhold, as long as support was given by mortgagees and tenants.

Transfer of undertakings

Article Abstract:

As a result of a number of actions, both in Britain and Europe, the Transfer of Undertakings (Protection Employment) Regulations 1981 have been expanded to include the sales of business premises. In the property industry, the sale of restaurants, pubs, shopping centres and nursing homes, are covered by the rules if they are to continue being used for the same purpose. Employees of such businesses, such as gardeners, maintenance staff and caretakers will come under the regulations and failure to comply can incur serious penalties.

Speak out for data freedom: from grand promises on freedom of information, it now seems that the government is dragging its feet

Article Abstract:

Freedom of information should be high on New Labour's agenda, although progress towards it has faltered. The RICS has been leading the property industry's call for easier access to data on land and property. Its consultation paper calls for price-paid information on Land Registry documents to increase the security of land transactions, raise the confidence of mortgage lenders and provide accurate information for economists, researchers and the government.
