Arbitration: it's all very hush-hush

Article Abstract:

Strict confidentiality is a vital element of the arbitration process, and this is why many companies choose arbitration rather than litigation to settle disputes. However, in London, England, arbitration was becoming as complex and expensive as litigation, and this was the driving force behind the 1996 Arbitration Act. This has extended the jurisdictions of arbitrators while restricting those of the courts. It is still too soon to establish whether this legislation has played a role in allowing London to regain the arbitration work it was losing to other international arbitration centres.

Efforts to eliminate terrorist activity in the wake of the attacks on the World Trade Centre and the Pentagon have raised questions about the defense of individual liberty. In the UK, there has been particular concern about Home Secretary David Blunkett's reference to ministers, instead of judges, as the ultimate protectors of civil liberties.

A legal assistance clinic has been created at Wormwood Scrubs prison by 24 students from the College of Law in London, England. The aim of this scheme is to establish general legal awareness and to show students how law works in practice.
