Voicing concerns about those who wish to stay silent

Article Abstract:

Suspects now no longer have an unconditional right to silence in the UK, and this has led to clashes between police interviewers and defence solicitors. The police feel that tactics adopted by some defence solicitors are hampering efforts to ensure that criminals are appropriately punished, and officers are now being given specific information about how to cope with such tactics. Defence solicitors are under great pressure to ensure that a refusal to answer questions does not count against their client in court.

Article Abstract:

According to Tony Dugdale, Keele University Professor of Negligence, the ruling by Lord Hoffmann in the 1995 South Australia Asset Management Corporation versus York Montague Limited indicates there is a difference between providing information and advice, and the liability of surveyors should be restricted to loss resulting from erroneous information. This means that surveyors are not expected to predict future property prices, which will help those with claims for damages against them.

A fierce fight at the Bar

Article Abstract:

The Inns of Court School of Law (ICSL) has been solely responsible for training barristers for work at the Bar in the UK for more than 140 years. However, this situation may change as it competes against 17 other universities and law schools to gain permission to operate Bar vocational courses from Sep 1997. It it does receive validation, it will have to operate in a commercial environment for the first time, and this will inevitably affect its future.
