In Hart Planners and Architects vs Evergreen Ltd, the owner filed for joint arbitration against the architect after settling his dispute with the contractor. The architect claimedthat the contractor cannot pursue the owner's claims due to the construction contract's provision on joinders. However, the court found no specific provision regarding third party assignment of claims and decided that the ownerwas within his rights in assigning his arbitrable claims to the contractor.
