No Winners in Patent Shootout

Article Abstract:

A jury has deadlocked in a 9-year-old patent infringement case between Genentech and the University of California (UC). The University claims that Genentech had infringed on their patent on the gene for human growth hormone. A Genentech employee testified that in 1978 he secretly retrieved portions of DNA that he had worked on as a UC post-doctorate student. However, his testimony was ultimately irrelevant to the case, and his professional behavior is now being unnecessarily scrutinized.
