Assisting the jury in understanding victimization: expert psychological testimony on battered woman syndrome and rape trauma syndrome

Article Abstract:

Courts are attempting to find a balance in considering expert psychological evidence between the concerns of feminist commentators that rape law is adjudicated according to male standards and general public concerns about the appropriateness of expert psychological testimony in court. Much controversy over expert evidence has occurred with the insanity defense. The rules for considering scientific evidence stated in United States v Downing are generally applicable, including the reliability of the process used to generate the evidence and the possibility that it could mislead the jury.
