Justice or just us: the tension between equality and freedom

Article Abstract:

The current equal protection standards employed by the US Supreme Court have eroded the guarantees that the 14th Amendment was intended to provide, and the strict scrutiny test should be replaced by an inquiry that focuses on promoting a diverse society in which everyone can fully participate. In practice, the strict scrutiny test has tended to separate Americans into individual interest groups. Efforts being made in South Africa to protect minority rights should be instructive that all people must be given meaningful access to social and political participation.

Popular justice: state judicial elections and procedural due process

Article Abstract:

State judicial elections violate procedural due process by failing to provide litigants with neutral adjudicators because of the political influence implicit in election and reelection. Congress or the courts should implement a system in which judges are not subject to reelection so that litigants can be assured that the potential for bias is minimized. Initial election or gubernatorial appointment would not offend due process because continuing political influence would be minimized.

The life and accomplishments of Rachel Ortiz as a community organizer and educator in various California Latino communities are discussed. Ortiz' work with youth gangs is discussed.
