Remaking Procrustes's bed: a model for non-exclusive labor law

Article Abstract:

Section 7 of the National Labor Relations Act (NLRA) gives employees free choice of representation, but it conflicts with NLRA section 9(a), which mandates exclusive representation by the union chosen by a majority of the bargaining unit employees. A non-exclusive form of employee representation is needed to protect free choice and ensure that employees do not become captives of the union. Such a system could allow multiple unions to represent employees belonging to one bargaining unit.

American MNCs continue to profit from the use of forced and slave labor begging the question: should America take a cue from Germany?

Article Abstract:

American multinational corporations profit from slave and forced labor. Litigation under the Alien Tort Statute has not succeeded in rectifying this situation. To solve this problem, the United States should set up a system similar to the one which Germany has constructed to handle restitution for Nazi-era forced labor.

An old solution to a new problem: physician unions take the edge off managed care

Article Abstract:

The author discusses the legal barriers to physician unionization and argues the elimination of these barriers would be beneficial to patients within managed care medical plans.
