"Unlawful combatants" in the United States: drawing the fine line between law and war

Article Abstract:

The cases of Jose Padilla and Yaser Esam Hamdi have raised issues concerning what due process rights must be granted to US citizens accused of crimes relating to international conflicts. Although the men have been declared "unlawful combatants" their status has not been reviewed by either military or civilian courts. They should have access to due process in the meantime.

Armed conflict and law in this century

Article Abstract:

The law of armed conflict is changing in several respects. Terrorism, new military technologies, and new methods of attempting to control national behavior have all caused a shift or strain in the twentieth century law of war. The preeminence of U.S. military power should also be a factor in this change.

Wars and terrorism threaten civil liberties and human rights

Article Abstract:

The United States fails to take account of human rights as it responds to the September 11, 2001 attacks almost exclusively by military power. Lawyers need to remind this nation that respect for human rights is needed in order to maintain constructive long-term relations with other countries.
