An HMO patient, Joyce Ching, died in Apr 1994, of colon cancer, after a series of operations that were allegedly delayed because of inattention by her primary physician. A lawsuit was filed, and the case has raised questions about the financial interests involved in a capitated health plan.

Should there be a limit on pain-and-suffering awards in malpractice suits?

Article Abstract:

Congress is considering a $250,000 limit on the 'pain and suffering' portion of malpractice lawsuits. Those in favor point out that such awards are unpredictable and subjective, while those opposed believe that such a limit would simply punish the patients who have suffered the most.

Panels of experts in two states compile 'report cards' on the success ratios of heart surgeons. Those who agree with the practice believe patients are entitled to such information, while those who disagree point out the difficulty of producing a fair report card.
