A reasonable question
Article Abstract:
The House of Lords has recently rejected a claim by a client for the cost of rebuilding a swimming pool which was not constructed in accordance with the contract specification. Instead, it awarded 4,000 pounds sterling for loss of amenity. This case may have much wider implications for the use of the loss of amenity principle in commercial situations. It is also important in terms of the role of architects and other contract administrators.
